Adverse Ruling in Zubik v. Burwell Would Endanger Access to Contraceptive Coverage for Countless Women

“Women’s ability to access birth control is critical to their health, equality and economic security. That is why it is so important that every woman has coverage for birth control, no matter where she works or goes to school. The seven consolidated cases in Zubik v. Burwell, which the U.S. Supreme Court is hearing oral arguments on today, are attacks on birth control coverage. An adverse ruling here would allow some employers to use religion to discriminate against female employees by denying them coverage for contraception.

Eight out of nine lower courts have ruled that the accommodations in the U.S. Department of Health and Human Services’ regulations are sufficient. These cases are nothing more than attacks on birth control. The plaintiffs in these cases have a special accommodation and already do not have to pay for contraceptive coverage. They must not be allowed another way to deny women access to birth control.

Women deserve access to contraceptive coverage regardless of where they work and what their bosses believe about birth control. We are confident that the Supreme Court will see the challenges under Zubik v. Burwell as the dangerous attacks on women’s health that they are and rule in favor of the administration. Women and families will be stronger, healthier and more secure if it does.”
