Florida, Texas Again Sue FDA Over Abortion Pill Approvals

On Tuesday, Florida and Texas filed a complaint against the U.S. Food and Drug Administration (FDA) for acting unlawfully when it approved, then eased safety restrictions on, mifepristone. The states are asking the Northern District of Texas Court to set aside and declare unlawful five agency actions, including mifepristone’s 2000 approval, changes allowing the drugs to be sent through the mail and distributed by pharmacies, and two approvals of generic versions. The states argue these actions violated the Administrative Procedure Act because they were arbitrary, capricious, an abuse of discretion, and not in accordance with law.

New research published by the Society of Family Planning showed that abortions nationwide climbed every year since the Supreme Court ended the constitutional right to an abortion in Dobbs v. Jackson Women’s Health Organization. The increase is largely because doctors in states that permit abortions are providing more abortions to people living in states where the procedure is banned or highly restricted. David Cohen, a law professor at Drexel University who co-wrote the book “After Dobbs” stated, “The reality is people are getting abortions, people are providing abortions, and the post-Dobbs environment is not stopping them.”
ICE Is Using Smartwatches To Track Pregnant Women, Even During Labor: ‘She Was So Afraid They Would Take Her Baby’

In the last few months, a Colorado hospital encountered three pregnant patients wearing ICE-mandated wrist monitors. BI Inc, the company responsible for the surveillance trackers, built and operated the wrist monitors as an alternative to ankle monitors. The Colorado hospital staff said all three women were fearful to take the monitors off even when it was medically necessary. A staff member who worked with a woman diagnosed with preeclampsia stated, “She was in tears about it. She had this deep fear that ICE was going to come to the hospital and take her baby.”
FDA Has Delayed Abortion Pill Safety Study, Bloomberg News Reports

The U.S. Food and Drug Administration has delayed a review of safety data for the abortion drug mifepristone at Commissioner Marty Makary’s request, Bloomberg News reported on Monday, citing people familiar with the matter. Makary has told agency officials to delay the safety review until after the midterm elections, the report said.
Punished For Bleeding: How Periods in Prison Become a Trap

According to a new report by the Prison Policy Initiative (PPI) and Miriam Vishniac, the founder and director of the Prison Flow Project, incarcerated women, trans and nonbinary people are punished for having periods across the country. The report identified at least six types of prison policies used to punish menstruating people including rules concerning damage of prison property, personal hygiene requirements, contraband restrictions, “feigning” illness and being absent from an assigned location. Stories from incarcerated menstruating people reflect the criminal legal system’s dehumanization of incarcerated people and how the criminal legal system ignores the health needs of incarcerated women and trans people.
