AG Ken Paxton Sues Another Out-of-State Provider Accused of Illegally Sending Abortion-Inducing Pills to Texans

The Texas Tribune, January 27, 2026

Texas Attorney General Ken Paxton filed a lawsuit against a Delaware nurse practitioner for allegedly mailing abortion medication into Texas, violating the state’s abortion ban. The nurse practitioner operates a Delaware-based group called Her Safe Harbor that prescribes abortion medication. This case will test Delaware’s shield law, which protects providers from out-of-state prosecutions. Delaware’s law does not include language explicitly protecting all providers regardless of where their patients are located. This is Paxton’s second lawsuit against an out-of-state healthcare provider, as Paxton previously sued a New York-based doctor over allegations that she mailed abortion pills into the state.

‘I Was Violated and Put in Extreme Danger:’ Women Denied Abortions Sue Over Arkansas Ban

The Guardian, January 28, 2025

On Wednesday, an Arkansas OB-GYN and three Arkansas women who were denied abortion care filed a lawsuit against Arkansas in an attempt to strike down its near-total abortion ban. Two of the petitioners were denied abortion care even though their pregnancies had effectively ended. The other petitioner was denied abortion care after experiencing sexual assault because Arkansas does not have a rape exception. The four petitioners argue that Arkansas’s abortion ban violates the state constitution’s guarantee that people have the right to equality, life, liberty, and the pursuit of happiness, and the ban is unconstitutionally vague.

The 19th, January 23, 2026

A pregnant detained woman in a Louisiana immigration detention facility experienced heavy bleeding and cramps, and once had to go to the emergency room. She received prenatal vitamins but has not seen a doctor outside of that emergency room visit. Lawmakers, immigration rights activists, medical providers, and formerly detained people raised concerns about how detention centers treat pregnant and postpartum people. Immigration and Customs Enforcement (ICE) did not respond to requests for comment and has drawn scrutiny for detaining pregnant, postpartum, and nursing people.

Trump Asks Federal Court To Hit Pause on Abortion Pill Case, Citing Ongoing Study

POLITICO, January 27, 2026

On Tuesday, in Louisiana’s lawsuit against the Food and Drug Administration over the accessibility of mifepristone, the Trump administration asked the court to put the lawsuit on hold while the FDA reviews the safety of mifepristone. The administration’s filing states the Trump administration is actively considering whether to keep current federal rules in place that allow access to mifepristone via telemedicine, mail delivery, and retail pharmacies. The filing also argues that Louisiana lacks standing and should sue doctors who prescribe the pills across state lines, rather than the Trump administration.

HHS Will Allow Pharmacies To Boycott Lifesaving Drugs Used in Medication Abortion

Mother Jones, January 28, 2026

On Tuesday, the Trump administration formally withdrew a 2022 rule that mandated retail pharmacies receiving any federal funding had to carry and dispense mifepristone, misoprostol, and methotrexate – drugs used in medication abortions and, in the case of methotrexate, the treatment of ectopic pregnancies and autoimmune disorders. The rescission allows pharmacists to refuse to stock or dispense misoprostol and methotrexate, despite their other uses. With HHS’s recession and the increased criminalization of abortion medication, there are concerns that even sympathetic doctors will be scared to prescribe mifepristone, misoprostol, and methotrexate.
